Terms & Conditions

These terms apply to every gap report, quotation and job that TRXLLR carries out, unless a signed contract for a particular job says otherwise. They are business-to-business terms.

1. Quotations

A quotation is valid for 30 days. It is based on the survey and the quantities we measured. Prices exclude VAT, which is added at the rate in force when we invoice.

2. The gap report

The gap report is free. It is yours to keep whether or not you go ahead with us.

3. Starting work

We start only on a written instruction or signed order. It sets out the scope, the price, the programme and the hours we may work.

4. Changes and hidden defects

Any change to scope, quantities or working hours is agreed in writing, with its price, before the work is done. If we open something up and find it worse than expected, we stop and tell you. Nothing extra is done without your written agreement.

5. Payment

On jobs lasting more than a month we apply for payment monthly for the work done. Shorter jobs are invoiced on completion. Payment is due 30 days from the invoice date. Payment notices, the right to suspend for non-payment and the right to adjudication follow the Housing Grants, Construction and Regeneration Act 1996, as amended. Interest on late payment is charged under the Late Payment of Commercial Debts (Interest) Act 1998.

6. Cancellation

You can cancel at any time by telling us in writing. If you cancel before work starts, you pay only for materials ordered for your job that cannot be returned. If you cancel after work starts, you pay for the work done to that date, those materials, and the reasonable cost of leaving site. The gap report stays yours either way.

7. Access and site information

You give us safe access at the agreed times, with power, water and welfare facilities. Before work starts you give us the asbestos register, the fire risk assessment and any other information about the building that we need, as the Construction (Design and Management) Regulations 2015 require.

8. Defects in our work

We put right, at no charge, any defect in our own work that you tell us about within 12 months of completion.

9. Liability

Our total liability for a job is limited to the price of that job. We are not liable for loss of profit, revenue or room income. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited.

10. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. This does not affect either side's right to adjudication.
